1. What these terms cover
- These Terms and Conditions govern all driving tuition and related services we provide in person and online (the “Services”).
- By booking or taking any lesson, you agree to these Terms.
2. Eligibility and legal requirements
- You must meet UK legal requirements to take driving lessons for a car (Category B), typically:
- Be at least 17 years old; and
- Hold a valid UK provisional driving licence; and
- Meet minimum eyesight rules and be medically fit to drive.
- If you’re under 18, we may require written consent from a parent/guardian.
- You must carry your provisional licence to your first lesson (and when asked thereafter).
3. Bookings, prices and payment
- How to book: Lessons can be booked via [phone/email/online booking link].
- Lesson length: Standard lessons are [60/90/120] minutes unless agreed otherwise.
- Pricing: Current prices are shown on our website or confirmed in writing at the time of booking. Prices include any applicable taxes.
- Payment: Pay in advance or at the start of each lesson by [bank transfer/card/cash/online]. Packages must be paid in full upfront unless we agree otherwise.
- Receipts: Provided on request by email.
- Travel/area: Pick‑ups are normally within [Aylesbury and nearby areas]. We may apply a travel surcharge outside our standard area—confirmed at booking.
4. Cancellations and rescheduling
- Your changes: Please give at least [48] hours’ notice to cancel or reschedule a lesson. Less than [48] hours’ notice may be charged at 100% of the lesson fee.
- No‑shows/late arrival: If you fail to attend or arrive more than [15] minutes late, the lesson may be shortened or charged in full.
- Our changes: We may reschedule lessons due to instructor illness, vehicle issues, weather, or safety concerns. We’ll give as much notice as reasonably possible and offer a new slot.
- Test‑day cancellations by DVSA: If the DVSA cancels your practical test (e.g., bad weather/strikes), we’ll reschedule the lesson portion where possible. Any car‑hire/test‑day fee handling is per section 7.
5. Packages, vouchers and expiry
- Packages: Discounted packages are valid for [6/12] months from purchase. Unused hours after expiry may be forfeited.
- Refunds on packages: If you request a refund, we’ll deduct hours taken at our standard (non‑discounted) rate plus any admin fees, and refund the balance of unused hours.
- Gift vouchers: Valid for [12] months, non‑transferable, and cannot be exchanged for cash. Treat as cash; lost or stolen vouchers may not be replaced.
6. Online lessons and consumer rights (distance contracts)
- Online Services include, for example, theory support or pre‑test coaching via video call.
Cooling‑off period
- If you book online or by phone, you may have a 14‑day cooling‑off period under the Consumer Contracts Regulations 2013. However:
- If you ask us to start the service within 14 days, you agree that we may begin immediately.
- You’ll pay for any services delivered before cancellation.
- Once a service is fully delivered within the 14 days, the right to cancel ends.
- Digital or downloadable materials are non‑refundable once accessed.
7. Practical test preparation and car hire for test
- Readiness: Your instructor decides if their vehicle is available for your test based on safety and readiness. There’s no guarantee our vehicle will be provided for a specific date.
- Minimum booking on test day: Typically a minimum of [2–3] hours (includes pre‑test warm‑up, vehicle hire, and post‑test return).
- Test fees: DVSA test fees are separate and paid directly to DVSA.
- If the DVSA cancels: We’ll help you rearrange your lesson time where possible. Any recovery of losses from DVSA is your responsibility.
8. Safety, conduct, and legal compliance
- Zero tolerance: No alcohol, drugs, or impairing medication before/during lessons. We may end a lesson immediately (chargeable) if we suspect impairment.
- Eyesight and health: You must be able to read a number plate at 20 metres and be medically fit to drive. Tell us about any relevant conditions.
- Seat belts: Must be worn unless you hold a valid legal exemption.
- Fines and penalties: As the driver, you are responsible for any penalties, fines, or offences you commit during a lesson or test.
- We may end a lesson if your driving is dangerous or conditions are unsafe. Lesson fees may still apply.
9. Instructors and vehicles
- Instructors: Lessons are provided by a DVSA Approved Driving Instructor (ADI) or a licensed Potential Driving Instructor (PDI) under supervision.
- Vehicle: Dual‑controlled, roadworthy, and insured for tuition and (if agreed) tests. We may change the vehicle at short notice due to maintenance or availability.
- Your vehicle: If we agree to teach in your own insured vehicle, you’re responsible for its roadworthiness and insurance. We may refuse if we consider it unsafe or uninsured.
10. Liability and insurance
- Insurance: Our tuition vehicle is insured for driving instruction and, if agreed, for use on the practical test when accompanied by your instructor.
- What we don’t promise: We cannot guarantee test dates, availability, or a pass result.
- Limitation of liability: We’re not liable for any indirect or consequential loss (e.g., loss of earnings or opportunities). Our total liability for any claim arising from a lesson is limited to the price you paid for that lesson.
- Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or any liability that cannot be excluded under UK law.
- Your statutory rights under the Consumer Rights Act 2015 are not affected.
11. Personal data and privacy (summary)
- We collect and process personal data (e.g., contact details, lesson history, payment references) to deliver and manage your lessons and bookings.
- Lawful bases: Contract (to provide lessons), legitimate interests (scheduling/quality), legal obligation (records), and consent where required (e.g., marketing).
- Sharing: We do not sell your data. We may share minimal data with service providers (e.g., scheduling, payment processors) under contract.
- Retention: We usually keep records for up to 6 years for accounting and legal purposes, then securely delete.
- Dashcams: Our vehicles may use forward‑facing dashcams for safety and insurance. Audio is normally off. Footage is overwritten periodically unless needed for an incident.
- Your rights: Access, rectification, erasure, restriction, portability, and objection under UK GDPR/Data Protection Act 2018. Contact us to exercise these rights.
- Cookies: See our Cookie Notice on the website.
- Full details: Please read our separate Privacy Policy [link]. By using our Services, you acknowledge this summary and the Privacy Policy.
12. Intellectual property
- All website content, materials, and training resources we provide are our intellectual property or used under licence. You may not copy, share, or resell materials without our written consent.
13. Complaints and feedback
- We aim to resolve issues quickly and fairly. Please contact us at [email/phone].
- If a matter cannot be resolved, you may seek advice from Citizens Advice or relevant ADR schemes. Nothing affects your legal rights.
14. Events beyond our control (force majeure)
- We’re not responsible for delays or failures caused by events outside our reasonable control (e.g., extreme weather, strikes, public emergencies, utility failures). We’ll reschedule where possible.
15. Changes to these Terms
- We may update these Terms from time to time. The version on our website at the time of booking applies to your booking. Material changes will be highlighted.
16. Governing law
- These Terms are governed by the laws of England and Wales. Disputes are subject to the exclusive jurisdiction of the courts of England and Wales.
